Terms and conditions of use

1. Purpose and nature of the Service

These Terms and Conditions (the "Terms") govern the download, installation, access to and use of the Aulify mobile application (the "App" or the "Service"), a self-study tool that lets you create your own subjects and topics from your study material and practise them through AI-generated mini-lessons and exercises.

Aulify is distributed as a mobile application for iPhone, downloaded from the Apple App Store. These Terms are also an End User Licence Agreement (EULA) between you and Aulify for that App.

The aulify.app website is an informational and legal site (product information, support and legal documents). It is not the way to use the Service: the study features are provided through the App. Any previous web version of the product is discontinued and no longer forms part of the Service; where these Terms refer to "the app" they refer to the iPhone application.

Downloading, registering for and/or using the App implies full and unreserved acceptance of these Terms. If you do not agree, do not install or use the App.

2. Ownership and contracting party

The Service is owned and operated by Aulify. Full identification details are set out in the Legal notice. These Terms are entered into between you and Aulify only, and not with Apple Inc. Aulify, not Apple, is solely responsible for the App and its content.

3. Licence granted (EULA)

Aulify grants you a personal, non-transferable, non-exclusive, revocable and non-sublicensable licence to install and use the App on Apple-branded devices that you own or control, and only as permitted by the App Store Terms of Service (including the Usage Rules). Family Sharing or volume purchasing, where applicable, may allow use by other members associated with your account.

You may not:

  • Copy, sell, rent, lease, sublicense, distribute or otherwise transfer the App.
  • Modify, adapt, translate, decompile, disassemble or reverse engineer the App, except to the extent such restriction is prohibited by law.
  • Remove or alter proprietary notices, or use the App on a device you do not own or control.
  • Use the App on jailbroken or otherwise tampered devices, or in ways that circumvent its technical limits.

The licence terminates automatically if you breach these Terms or delete your account.

4. Devices, compatibility and updates

  • The App is published for iPhone. It may run on other Apple devices in compatibility mode, but Aulify only supports and optimises the iPhone experience and does not guarantee correct operation on other devices or form factors.
  • You need a compatible iOS version, an Apple Account and an active internet connection. The App is not designed to work offline: AI generation, exercises and progress sync all require connectivity.
  • Data charges, connectivity, device and battery consumption are your responsibility and governed by your carrier's terms.
  • We may release updates. Some updates are necessary for the Service to keep working; if you do not install them, part or all of the App may stop functioning. We may also discontinue support for older iOS versions.

5. Device permissions

The App only requests permissions that you can grant or deny from iOS Settings, and it works without them (with the related feature disabled):

  • Microphone — voice dictation in the chat. Speech recognition runs on your device; the audio is not sent to Aulify.
  • Camera / Photos — only if you choose to attach a photo of your notes or an exercise. These images are stored in a private area and deleted within 24 hours.
  • Notifications — optional study reminders, only if you accept them.

The App contains no advertising and no third-party tracking SDKs, and does not track you across other companies' apps or websites.

6. Access and daily limit

Aulify is currently offered free of charge. To keep the service sustainable and prevent abuse, each account may create a maximum of 10 new topics per day, plus internal messaging limits designed to prevent automated or abusive use. These limits may be adjusted; we will inform you inside the App where reasonably possible.

7. Minimum age

Aulify is intended for people aged 16 or over, the age at which article 7 of the LOPDGDD allows valid consent for the processing of personal data in digital services. The App's App Store age rating is consistent with this requirement, and the App shows an age confirmation at sign-up. When you register, you declare under your own responsibility that you meet this age requirement.

If we have reasonable evidence that an account belongs to a person under 16, we will suspend the account and delete the associated data. Parents or legal guardians may request erasure at any time by writing to hello@aulify.app (see GDPR rights request).

8. Registration, account and deletion

  • Registration is done inside the App through Sign in with Google, Sign in with Apple or email and password (with email verification). The data provided must be truthful and kept up to date.
  • You are responsible for the confidentiality of your credentials and for any activity carried out with them. Protect your device with a passcode or biometrics.
  • You must notify us immediately of any unauthorised use of your account.
  • You can delete your account and all your data at any time from within the App (Profile → Delete account). Deleting the app from your device does not delete your account; use the in-app option or write to hello@aulify.app.

9. Acceptable use

You undertake to use the Service in accordance with the law and these conditions, and to refrain from:

  • Uploading content over which you do not hold sufficient rights (third-party intellectual property without a licence, etc.).
  • Uploading unlawful, offensive, discriminatory, violent, hateful or pornographic content, or content infringing fundamental rights.
  • Uploading sensitive personal data of third parties (health, exam records, minors' data) without a legal basis.
  • Using the Service to impersonate others, collect third-party data without consent or carry out fraudulent activities.
  • Reverse engineering, decompiling, denial-of-service attacks, mass scraping or attempting to breach platform security.
  • Using the Service as a generic AI API, as a general-purpose chatbot unrelated to study, or to train third-party models without express authorisation.
  • Deliberately overloading the infrastructure through unauthorised automation, emulators or modified clients.

Uploaded material is automatically screened; content that clearly breaches these rules is blocked and the topic is not generated. Repeated breaches may lead to suspension.

10. User content

You retain ownership of the documents and materials you upload. By uploading them, you grant Aulify a limited, non-exclusive, worldwide and revocable licence to store and process them for the sole purpose of providing the Service (syllabus extraction, generation of mini-lessons and exercises, progress tracking). Your material is not used to train AI models.

You warrant that you hold the necessary rights over the uploaded content and will hold Aulify harmless against any third-party claim arising from infringement of rights by that content.

11. Use of artificial intelligence

  • The Service uses generative AI models to produce mini-lessons, exercises and covers. Responses may contain errors or inaccuracies and must be reviewed before being used for critical purposes.
  • Generated content does not constitute professional advice of any kind (legal, medical, financial, etc.) and does not replace study from official sources.
  • Aulify does not guarantee that responses are always complete, accurate or suitable for a specific case, nor that they are free from bias.
  • If you encounter generated content that you consider offensive or inappropriate, you can report it at hello@aulify.app; we review reports and act on them, including blocking material or suspending accounts.

12. Price, purchases and Apple

The App is currently free and includes no paid plans, subscriptions or in-app purchases. Should paid features be introduced in the future, they would be processed exclusively through Apple In-App Purchase, managed by Apple and subject to Apple's own terms; they could be managed, cancelled or restored from your Apple Account settings, and refunds would be handled by Apple. Aulify does not store card data and does not process payments outside Apple's system.

13. Availability of the Service

Aulify will make reasonable efforts to keep the Service available 24/7. No service level (SLA) is guaranteed, nor the complete absence of interruptions due to maintenance, provider failures, external attacks, App Store issues or force majeure. Since the App is free, we may modify, limit or discontinue features, or the App as a whole, giving notice where reasonably possible.

14. Suspension and cancellation

We may suspend or cancel your access, in whole or in part and without prior notice, in the event of a serious breach of these Terms, legal requirement or security reasons. You may cancel your account and delete all your data at any time from the App (Profile → Delete account) or by writing to hello@aulify.app.

15. Intellectual property

The software, brand, design and any other elements of the Service belong to Aulify or its licensors. Any reproduction, distribution, public communication or transformation without express authorisation is prohibited. Content generated by the AI from your material may be used freely for your personal study.

16. Warranty and limitation of liability

To the maximum extent permitted by applicable law, the App is provided "as is" and Aulify shall not be liable for indirect damages, loss of profit, data loss or consequential damages arising from the use or inability to use the Service, nor for consequences arising from reliance on AI-generated content. The above does not exclude or limit liability for wilful misconduct, gross negligence, death or personal injury, statutory consumer rights, or any other liability that cannot legally be excluded.

17. Specific Apple App Store terms

The following applies because the App is distributed through Apple's App Store:

  • Parties. These Terms are between you and Aulify only, not with Apple. Aulify is solely responsible for the App and its content.
  • Scope of licence. The licence in section 3 is limited to use on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
  • Maintenance and support. Aulify is solely responsible for support at hello@aulify.app. Apple has no obligation to provide any maintenance or support.
  • Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Aulify's responsibility.
  • Product claims. Aulify, not Apple, is responsible for addressing any claims relating to the App, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
  • Intellectual property claims. If a third party claims the App infringes their intellectual property rights, Aulify, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
  • Third-party terms. You must comply with applicable third-party terms when using the App.

18. Right of withdrawal

Since the App is free and no payment is made, there is no price to refund. You may stop using the Service at any time by deleting your account in the App. If paid features are introduced in the future, purchases and refunds will be governed by Apple's terms and by the applicable consumer rules on digital content.

19. Data protection

The processing of personal data is governed by the Privacy policy, which forms an integral part of these Terms. The Cookie policy explains that the App uses no advertising or analytics cookies (only strictly necessary local storage).

20. Modifications

We may modify these Terms to reflect legal, technical, App Store or Service changes. We will notify substantial changes at least 15 days in advance, in the App or by email. Continued use after they take effect implies acceptance of the new version.

21. Applicable law and jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts of the consumer's domicile where the user qualifies as a consumer; otherwise, to those of Aulify's domicile.
